These Terms & Conditions (“Terms”) are a binding agreement between you and Forged To Fit, LLC (“ForgedToFit”, “we”, “us”, or “our”), which operates the ForgedToFit website (the “Site”). They govern your access to and use of the Site and any quotes, designs, or products you request through it (the “Services”). By using the Site, submitting a form, or uploading any image or design, you agree to these Terms. If you do not agree, do not use the Site.

1. What we do

ForgedToFit designs and arranges the manufacture of custom and made-to-order wheels. Images shown on the Site are examples and inspiration; every wheel is built to order. Any price, estimate, or quote we provide is an estimate only, is non-binding, and may change based on final specifications, materials, fitment verification, shipping, duties, and taxes. No order is confirmed until we expressly accept it in writing and any required deposit is received.

2. Content you submit — your responsibilities

The Site lets you upload photos, screenshots, drawings, or other materials (“User Content”) to describe the wheel you want. You are solely responsible for the User Content you submit. By submitting User Content, you represent and warrant that:

• you own the User Content, or have all rights, licenses, and permissions necessary to submit it and to authorize the uses described below;
• the User Content does not infringe or misappropriate any third party’s copyright, trademark, trade dress, design right, patent, publicity, privacy, or other right;
• the User Content is not unlawful, defamatory, or otherwise objectionable; and
• your request to reproduce, adapt, or manufacture a design based on the User Content does not violate anyone’s rights.

You must not upload images, renderings, or designs that belong to another wheel brand, manufacturer, designer, or other third party unless you hold the rights to do so. Brand names, model names, and logos referenced anywhere on the Site or in your request remain the property of their respective owners; any reference is for identification, compatibility, or fitment purposes only and does not imply affiliation, sponsorship, or endorsement.

3. License to your content

You retain ownership of your User Content. You grant ForgedToFit a non-exclusive, worldwide, royalty-free license to store, reproduce, adapt, and use the User Content solely to evaluate your request, prepare estimates and designs, communicate with you, and, if you place an order, to manufacture and deliver your product. We do not claim ownership of your User Content and will not use it for unrelated public marketing without your permission.

4. We may refuse or remove content

We may, at our sole discretion and without liability, decline, pause, or cancel any request, and refuse, remove, or destroy any User Content, if we believe it may infringe a third party’s rights, violate these Terms or any law, or is otherwise inappropriate. We are not obligated to monitor User Content, and we are not responsible for User Content submitted by users.

5. Indemnification

You agree to defend, indemnify, and hold harmless ForgedToFit and its owners, officers, employees, contractors, and manufacturing partners from and against any claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your breach of the representations and warranties in Section 2; (c) your violation of these Terms; or (d) your infringement or misappropriation of any third party’s intellectual property or other rights. This obligation survives termination of these Terms.

6. Copyright complaints (DMCA)

We respect intellectual property rights. If you believe content on the Site or content we have been asked to produce infringes your rights, contact us through our contact page with: (a) a description of the work you claim is infringed; (b) the location or description of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on their behalf. We will respond to valid notices, including by removing infringing material and, where appropriate, declining or cancelling related requests.

7. Intellectual property of the Site

The Site, including its text, layout, graphics, and the photography and design assets we provide, is owned by ForgedToFit or its licensors and is protected by intellectual property laws. You may not copy, scrape, republish, or create derivative works from the Site without our written permission.

8. Disclaimers

The Site and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that any estimate will match the final price. Fitment, load ratings, and specifications must be confirmed for your specific vehicle before installation and use; you are responsible for ensuring any product is safe and legal for your intended use.

9. Limitation of liability

To the fullest extent permitted by law, ForgedToFit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or Services. To the fullest extent permitted by law, our total liability for any claim relating to the Site or Services will not exceed the amount you paid to us for the specific product or service giving rise to the claim.

10. Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted on this page with a new “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Wisconsin and applicable United States federal law, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of those courts.
